Welcome. These terms cover your use of the Suncalp pre-launch marketing website. They're written to be clear, not to trip you up — but because they're a legal agreement, the language stays precise. By using this site, you agree to what's below.
1. Acceptance of these terms
These Terms of Service ("Terms") are a legal agreement between you and RAYFINITE LLC ("Suncalp," "we," "us," or "our") governing your access to and use of the suncalp.com website (the "Site"). By accessing the Site or submitting your email to the waitlist, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.
2. The Site and the waitlist are informational
Suncalp is a forthcoming mobile app that has not yet launched. The Site exists to share information about Suncalp and to let you join an early-access waitlist. Joining the waitlist is free and informational only: it is not a purchase, subscription, contract for the app, or any guarantee. We make no promise that the app will launch, that it will launch on any particular date, that you will receive early access, or that any described feature will be available. Anything on the Site describing the planned app is forward-looking and may change.
3. Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction, if higher) to submit your email to the waitlist. By doing so, you confirm that you meet this requirement and that the email you provide is your own or one you are authorized to use.
4. Acceptable use
When using the Site, you agree not to:
- Submit false, misleading, or someone else's information without authorization;
- Use the waitlist form or Site for spam, abuse, or any unlawful purpose;
- Attempt to disrupt, overload, probe, or gain unauthorized access to the Site or its underlying systems;
- Scrape, harvest, or copy Site content except as permitted by these Terms; or
- Use the Site in any way that infringes the rights of others or violates applicable law.
5. Intellectual property
The Site and its content — including the Suncalp name, logo, wordmark, text, graphics, design, and layout — are owned by RAYFINITE LLC or its licensors and are protected by intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable license to view the Site for your own informational use. You may not reproduce, distribute, modify, or create derivative works from the Site or its branding without our prior written permission.
6. Third-party links
The Site may link to third-party websites (for example, RAYFINITE LLC's corporate site). We are not responsible for the content, policies, or practices of any third-party site, and a link does not imply our endorsement.
7. Disclaimers — the Site is provided "as is"
The Site is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including (to the fullest extent permitted by law) implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, secure, or free of harmful components, or that any forward-looking statement about the forthcoming app will come to pass.
8. Limitation of liability
To the fullest extent permitted by law, RAYFINITE LLC and its members, officers, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or relating to your use of (or inability to use) the Site — even if we have been advised of the possibility of such damages. To the extent any liability cannot be excluded, our total aggregate liability arising out of or relating to the Site will not exceed USD $100.
9. Changes to the Site and these Terms
We may modify, suspend, or discontinue the Site (in whole or in part) at any time, and we may update these Terms from time to time. When we make a material change to these Terms, we will revise the "Effective date" above and post the updated Terms on this page. Your continued use of the Site after an update means you accept the revised Terms.
10. Governing law
These Terms are governed by the laws of the State in which RAYFINITE LLC is organized (the State of Delaware, United States), without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to these Terms or the Site will be subject to the exclusive jurisdiction of the state and federal courts located in that State, to the extent permitted by applicable law.
